According to the Employee's Compensation Ordinance, It is the responsibility of the employer to purchase Domestic Helper Insurance for local / foreign helpers.
Employer shall bear the medical expenses to the Helper, when she is ill or injured. Free Medical treatment includes Medical Consultation, Hospital Stay and Emergency Dental Treatment.
Starting from April 1, 2003, the revised Employment Contract have clearly states that Employers are not responsible for providing free medical treatment during the period the Helper leaves Hong Kong of her personal purposes e.g. home leave.
A Helper shall accept medical treatment by any registered medical practitioner as provided by the Employer. It is advisable to the Employer to reach a prior agreement with the Helper as to which medical practitioner should be consulted in times of illness and injury.
The Employer should pay the Helper sickness allowance on the following circumstances:
| Helper has accumulated the number of paid sickness days |
| Sick Leave is taken not less than 4 consecutive days |
| Sick leave is supported by an appropriate medical certificate |
The Helper is entitled to 2 days paid sick leave for each completed month of service during the first 12 months of employment and 4 days for each month of service thereafter subject to maximum of 120 days.
Maternity Protection
The Helper is eligible for 10 weeks' paid maternity leave on the following circumstances:
| Helper has been employed not less than 40 weeks immediately before the commencement of scheduled maternity leaves |
| Helper has given notice of pregnancy confirmed by a medical certificate to Employer |
| Helper produced a medical certificate specifying the expected date of confinement |
Except in cases of summary dismissal due to helper's serious misconduct, an Employer is prohibited from dismissing a pregnant Helper from the date on which the pregnancy was confirmed by Medical Certificate.
