Guide for Foreign Domestic Helpers and Employers
 
Rest Days, Holidays and Leaves

Under Employment Ordinance, foreign domestic helpers entitled to the following holidays:

- Rest Days
- Statutory Holidays
- Paid Annual Leave

If the Employer is to renew the contract with the Helper, the Helper shall be allowed to return to her place of origin before the new contract commences of not less than 7 days. The expenses will be paid by the Employer.

The Helper must be given a one-day rest day in every period of 7 Days. The Employer must not ask the Helper to work on her Rest Day, including Statutory Holidays

A Helper is entitled to Paid Annual Leave after serving every period of 12 months with the same Employer.

The Paid Annual Leave will increase progressively from 7 days to maximum of 14 days according to the length



The Annual Leave Days will be appointed by the Employer after consultation with the Helper and to be confirmed with a written notice to the Helper of 14 days in advance.

The Annual Leave Days will not include the rest day or statutory holiday. Another rest day will be appointed.

If the employer will be going abroad, the Employer shall not unilaterally impose no-pay to the helper. The Arrangement shall be of mutual consent between both parties.

On Termination of Contract, the Helper should be given payment in lieu of any annual leave not yet taken in respect of every 12 month's completed service.
